1. registration/payment
Please register in writing using the registration form above for the desired trip/trekking/expedition. Early registration guarantees you a free place and the best possible conditions for the flights booked for you. We must be in possession of your registration no later than 90 days before the start of the trip. With your registration, these General Terms and Conditions become part of the contract between you and the organiser, even if you have only registered verbally or by telephone. After receipt of your registration you will receive a written confirmation with the detailed programme and the equipment list. After receipt of this, we ask you to transfer the deposit according to the details in the travel confirmation. The remaining amount is due 60 days before the start of the course. If you book later, the full amount must be paid immediately.
2. preparation
An excellent physical condition and good alpine technical knowledge are essential for your own safety and the success of the trip/trekking/expedition. All participants must prepare themselves for the trip through appropriate training. The preparation and its organisation are the responsibility of the participant. Participants who are not able to cope with the physical and alpine requirements may be excluded from the trip without any right to a refund, and will have to bear any additional costs incurred as a result.
3. obligations of the participants
The participants commit themselves to mutual recognition, respect, helpfulness and comradeship. Respect for the mountain guide, for the staff of our local partner organisations and for third parties is also a matter of course.
The participants undertake to respect the rights, customs and traditions of the respective countries and to behave in an environmentally conscious manner.
In order to protect their relatives, participants undertake not to disclose any information about the event, the course of the accident or individual participants to the public in the event of an accident without the express consent of the mountain guide or organiser, and also to ensure that personal messages, reports, e-mails etc. are not published by the addressees.
4. programme changes
The programme is expressly subject to change. There is no entitlement to reach the planned summits or the planned goals. The organiser can of course not give any guarantee in this respect. Our tours/trekking/expeditions take place in all weathers. We reserve the right to make changes to the programme and in particular to the area. Guests agree to this circumstance by signing the registration form. Any additional costs will be charged to the guest.
5. leadership of the trip/trekking/expedition
The trip/trekking/expedition is led by a mountain guide sent by the organiser. The indication of the mountain guide in the programme is purely informative and not binding. The decisions and instructions given by the mountain guide during the trip must be followed. If a participant disagrees with the decisions of the mountain guide, he/she may be excluded from the trip. The excluded participant shall, as soon as it is reasonable under the circumstances, make the early return journey at his/her own expense and responsibility. An excluded participant shall not be entitled to any reimbursement claims against the mountain guide and the organiser. If the mountain guide drops out before the start of the trip, it is at the discretion of the organiser to provide a replacement mountain guide or to cancel the trip. If the mountain guide drops out en route (accident, illness, etc.), the participants shall choose a new guide from among themselves and inform the organiser immediately.
6. insurance
As a cantonally approved mountain sports school, the organiser has comprehensive liability insurance. Otherwise, the participants are not insured by the organiser. Adequate insurance is the responsibility of each participant. We recommend that you have sufficient health and accident insurance cover and that you make sure you have worldwide cover. You should also take out cancellation and travel expenses insurance when you make your booking. This is compulsory and will be checked by us. We also recommend luggage and theft insurance.
7. price
You can see which services are included in our price under the respective offer. For offers with flights included in the package price, the price is valid until 180 days before the start of the trip. We are happy to accept bookings at short notice, but this may result in a price surcharge.
8 Withdrawal from the contract (cancellation)
8.1 Withdrawal by the client
Cancellation on your part must be made in writing and only becomes valid on the day on which the submitted documents are received by the organiser. In any case, a processing fee of CHF 100.00 will be charged. In addition, we will charge you the following costs (as a percentage of the package price): on receipt of the cancellation notice up to 120 days before departure, the deposit paid, up to 90 days before departure 60%, up to 60 days before departure 80%, thereafter 100%. For trips that are carried out despite not reaching the minimum number of participants according to the invitation to tender, there is no possibility of a refund at any time. For cancellations for compelling reasons, you are covered within the framework of your obligatory cancellation costs insurance to be taken out by you. The postponement of the travel date is considered a cancellation of the booked trip/trekking/expedition and a new booking for another trip. No refund can be made in the event of premature termination or interruption of the trip.
8.2 Cancellation by the organiser
If the minimum number of participants is not reached or if there are other circumstances (security, official measures or otherwise force majeure) which prevent the offer from being carried out, the organiser can withdraw from the contract at short notice. If the customer cannot or does not wish to rebook for any of the substitute offers offered to him, he will be refunded the payments made less the services already claimed. Further claims for compensation are excluded.
9 Liability
The organiser shall be liable for deficiencies in the implementation of the offers, insofar as this involves a failure of agreed services or changes which mean a reduction in value compared to the original agreement. This liability shall in any case only apply up to the amount of the agreed offer price and only for direct damage. The organiser shall not be liable for disadvantages and damages of any kind if these have been caused through no fault of the organiser or an auxiliary person of the organiser. The organiser shall only be liable for the actions of the tour leader if he/she acts culpably in the performance of his/her duties.
Participation in our tours/trekkings/expeditions requires independent mountain climbing with regard to the ascents. The mountain ascents are carried out on the participant's own responsibility and at his/her own risk. During the trip/trekking/expedition, the mountain guide is only available for the overall guidance of the group, but not as a mountain guide for the individual participant. We cannot be held liable for any damage to health or accidents or for not reaching the summits as a result of force majeure, adverse conditions, bad weather or insufficient technical and fitness requirements of the participants. Please bear in mind that every mountaineering trip/trekking/expedition has an air of adventure and risk. This is certainly also what makes it so appealing. However, please keep this in mind when booking and take part in this trip/trekking/expedition in full awareness of these circumstances.
10. right to one's own image
During the trip/trekking/expedition pictures will be taken by the mountain guide or the other participants, which may show recognisable individuals. The organiser is free to use the pictures of the mountain guide or the other participants, if they are handed over to the organiser, in particular for picture galleries, print products and web and social media pages.
For the reports of the event in the web and social media presence of the organiser, pictures are already used during the trip/trekking/expedition.
A right to refuse the publication of pictures in which the participant recognises him/herself must be asserted in writing to the organiser before the start of the trip.
11. organiser
is, unless otherwise stated, the Swiss Mountaineering School Alpine Action Unlimited based in Flims, Switzerland.
12 Applicable law and place of jurisdiction
All legal relations between the customer and the organiser are subject to Swiss law. The exclusive place of jurisdiction for all disputes arising from this contract is Trin, provided Alpine Action Unlimited acts as organiser.
